      G.O. Ms. No. 118 - dated - 22-7-2022 - Tamil Nadu SGST
      Seeks to amend Notification No. II(2)/CTR/532(d-5)/2017 dated 29th June, 2017
      Summary: The notification amends Schedule entries to replace various qualifying phrases with the standard phrase ", other than pre-packaged and labelled", omits specified Schedule entries, and substitutes Explanation clause (ii) to define pre-packaged and labelled by reference to a "pre-packaged commodity" under the Legal Metrology Act, 2009, requiring the package or label to bear the statutory declarations. The amendment is effective from 18th July, 2022.

      Seeks to amend Notification No. II(2)/CTR/532(d-4)/2017 dated 29th June, 2017
      Summary: Amendments revise tariff classifications and rate categories by adding a new schedule, substituting numerous entries to qualify goods as pre-packaged and labelled, inserting and omitting specified items across Schedules I, II, III and VI, introducing an explicit E waste entry, rewording diamond and synthetic stone descriptions, and defining 'pre-packaged and labelled' by reference to the Legal Metrology Act; the changes are effective from 18th July, 2022.

      Amendment in Notification No. II(2)/CTR/532(d-16)/2017 dated 29th June,2017
      Summary: The notification amends prior provisions so that suppliers registered under the TNGST Act who have exercised the option to pay tax on GTA services under forward charge and who issue a tax invoice charging State Tax with the prescribed Annexure III declaration are excluded from the prior entry; it inserts entry 5AA making renting of residential dwelling to a registered person a specified taxable service and adds Annexure III; the notification is effective from 18th July, 2022.

      Seeks to amend Notification No. II(2)/CTR/532(d-15)/2017 dated 29th June, 2017
      Summary: State GST notification amendments reconfigure exempt and nil-rated service entries by omitting certain listed entries and wording, inserting a residential dwelling rental exception for registered persons, specifying air travel exemptions limited to economy class from designated airports, narrowing warehousing exemptions to storage of cereals, pulses, fruits and vegetables, adding Department of Posts ordinary postal services as nil-rated, and creating a proportional exemption for tour operator services supplied to foreign tourists representing the portion of the tour performed outside India with an explicit calculation rule.

      Seeks to amend Notification No. II(2)/CTR/532(d-14)/2017 dated 29th June, 2017
      Summary: Amendments recast service schedule entries, specifying revised State tax rates and input tax credit restrictions for various transport and health services, insert ropeway passenger and goods transport entries taxed at a reduced rate with no input tax credit on goods used, create a category for clinical establishment room charges above a threshold subject to reduced rate and no input tax credit, and add an option mechanism (Annexure V) for Goods Transport Agencies to elect forward charge taxation for a financial year with a prescribed declaration and restrictions on input credit.

      Trading Window closure period under Clause 4 of Schedule B read with Regulation 9 of SEBI (Prohibition of Insider Trading) Regulations, 2015 (“PIT Regulations”) – Framework for restricting trading by Designated Persons (“DPs”) by freezing PAN at security level
      Summary: SEBI requires depositories and exchanges to implement a system restricting trading by Designated Persons via PAN freeze at security level around financial-result disclosures for companies in benchmark indices. Listed companies must confirm ISIN, DPs' PANs and closure start/end dates at least two trading days prior (T-2); the Designated Depository will relay details to exchanges and other depositories by T-1 and daily during closure. Demat accounts are identified by PAN; on-market, off-market and pledge transactions will be restricted from commencement (T day), with additions, deletions or exemptions effected within two trading days and freezes processed post market hours.

      Enhanced guidelines for debenture trustees and listed issuer companies on security creation and initial due diligence
      Summary: Debenture trustees and issuers must amend the debenture trust deed before due diligence; the DT shall perform initial due diligence per prescribed formats and issue a no-objection certificate (NOC) permitting security creation. The issuer must create the security, execute the charge in favour of the DT and register the charge with applicable registries within thirty days; thereafter the issuer and DT shall execute a supplemental debenture trust deed and submit the NOC, executed deed, DT undertaking of creation and registration, and other required documents to depositories and stock exchanges for ISIN reassignment.

      Extension of validity of Status Certificates issued in FY 2015-16 and 2016-17 under current FTP
      Summary: Status Certificates issued under the Foreign Trade Policy (2015-2020) for recognitions filed in FY 2015-16 and FY 2016-17 shall be valid for five years from the application date or until 30.09.2022, whichever is later, pursuant to an amendment to para 3.20(a) of the Handbook of Procedures effected by the Director General of Foreign Trade.
