      Amendment in Notification No. 131/2016 - Customs (N.T.), dated the 31st October, 2016 - Customs, Central Excise Duties and Service Tax Drawback Rules, 1995
      Summary: Applicability of the rates and caps of drawback is conditioned on exporter declarations and, where necessary, satisfaction of the Assistant Commissioner or Deputy Commissioner of Customs that no input tax credit under CGST or IGST has been or will be availed on the export product or its inputs or that no IGST refund will be claimed; exporters must also declare that they have not and will not carry forward any Cenvat credit under the Central Goods and Services Tax Act, 2017. The amendment has effect from 1 July 2017.

      Summary: The State notifies that activities or transactions undertaken by governments or local authorities as public authorities in relation to Panchayat functions under article 243G shall be treated neither as a supply of goods nor a supply of service for GST purposes, with effect from 1 July 2017.

      Notifies the categories of supply of services.
      Summary: Notification prescribes that specified categories of services shall attract payment of the whole of state tax on a reverse charge basis with the recipient located in the taxable territory liable to pay; it lists service categories (including GTA transport, representational legal services to business entities, arbitral tribunal services, sponsorships, certain government-supplied services, director's services, insurance and recovery agent services, and copyright transfers) and specifies supplier and recipient classes, with explanatory clarifications on freight payers, statutory definitions and treatment of litigant business entities.

      Supplies of goods Canteen Stores Department.
      Summary: The Canteen Stores Department is entitled to claim a refund equal to fifty per cent of the applicable state tax paid on all inward supplies received for the purpose of subsequent supply to Unit Run Canteens of the CSD or to its authorized customers; this specification is made under section 55 of the Punjab Goods and Services Tax Act, 2017 and takes effect from 1 July 2017.

      no refund of unutilized input tax credit accumulated on account of rate of tax on inputs being higher than the rate of tax on the output supplies of such goods.
      Summary: Notification under the Punjab GST Act designates specified tariff items for which no refund of unutilized input tax credit shall be allowed where credit accumulated because input tax rates exceed output tax rates on those goods (excluding nil rated or fully exempt supplies). The listed goods include specified textile fabrics, knitted fabrics, and railway rolling stock, parts and track fixtures. Interpretation follows the First Schedule to the Customs Tariff Act, 1975. The measure is effective from 1 July 2017.

      Intra-state supply of services the state tax shall be paid on reverse charge basis.
      Summary: Reverse charge obligation is imposed on the recipient for specified intra state supplies of goods, including cashew nuts, bidi wrapper leaves, tobacco leaves, silk yarn manufactured from raw silk or cocoons, and supply of lottery, with the supplier and recipient classes identified for each entry (agriculturist or specified supplier; any registered person or lottery distributor/selling agent). The notification adopts tariff based identification by reference to the Customs Tariff Schedule and applies its interpretive rules, making all provisions of the Act applicable to the recipient liable to pay state tax on reverse charge basis.

The Schedule links exempt descriptions to tariff Chapter/Heading/Sub heading/Tariff item entries, lists numerous agricultural, animal, processed and miscellaneous goods, and includes qualifications based on presentation (for example, exclusion where goods are put up in a unit container or bear a registered brand name). Interpretative rules of the Customs Tariff First Schedule apply.

      Intra-state supply of services.
      Summary: The notification prescribes levy of state tax on intra state supplies of services listed in the attached Table and Annexure, with specified percentage rates and conditions. Several rates are made conditional on input tax credit not having been taken and require reversal where inputs are partly used. Special valuation rules apply to construction supplies involving land (land deemed one third of total) and lotteries (100/112 or 100/128 rules). The Annexure provides the detailed Scheme of Classification of Services. Effective 1 July 2017.

      Summary: The CBDT directs that the Principal Director General of Income-tax (Systems) shall furnish bulk information under section 138(1)(a) to the Ministry of Corporate Affairs, limited to corporate PAN data, specified fields of corporate ITRs and audit reports, corporate SFT information, identified PAN-CIN and PAN-DIN associations, and other data necessary to identify dormant companies. Sharing will occur under a Memorandum of Understanding addressing transfer mode, confidentiality, secure preservation and disposal, reciprocal information flow, and agreed timelines, with a copy of the MoU forwarded for record.

      Summary: Provisions defining zero rated supply under the IGST framework apply mutatis mutandis to the Compensation Cess on exports. Exporters may either claim refund of Compensation Cess paid or export under bond/Letter of Undertaking without paying Compensation Cess and claim refund of unutilised input tax credit of Compensation Cess attributable to the exports. The circular directs issuance of trade/public notices and reporting of implementation difficulties.

      Exim Bank's Government of India supported Line of Credit of USD 24.54 million to the Government of the Republic of Ghana
      Summary: A Government of India supported Line of Credit (LoC) from Exim Bank to Ghana finances export of eligible goods and services for a sugarcane development and irrigation project, requiring at least 75% of contract value to be supplied from India and allowing 25% procurement from abroad. The LoC is effective from July 7, 2017 with a terminal utilisation period of 60 months after scheduled completion. Shipments must be declared on the Export Declaration Form; no agency commission is payable under the LoC though exporters may remit commission from their own resources or EEFC balances subject to AD Category I bank compliance. Directions are issued under Section 10(4) and Section 11(1) of FEMA.
