      Summary: The Standard prescribes uniform principles for capacity measurement and reporting for cost statements and other purposes, defining installed, practical, actual, normal, licensed, excess and bottleneck capacities. Installed capacity is based on technical specifications, evaluations, production centre capacities, critical equipment constraints and available shifts, with government directions and expert estimates applicable where necessary; reassessment follows physical or regulatory changes. Normal capacity is adjusted from installed capacity for planned maintenance, shifts, holidays and normal time losses. Cost statements must present installed and normal capacity, actual production and utilization percentage, and disclose bases, changes, outsourcing impacts, low utilization reasons and abnormal under utilization costs when material.

      Summary: The electronic credit ledger may be blocked to prevent utilization only up to the credits actually available; creating a negative balance is not authorized. Rule 86A allows disallowing debits equivalent to amounts allegedly fraudulently availed but does not permit insertion of negative credits when no input tax credit exists. Allegations of wrongful or fraudulent availment should be addressed through formal recovery proceedings rather than by making the ledger negative.

      Summary: The adjudicating authority imposed interest on excess wrongful ITC despite the taxpayer having deposited the disputed tax; the appellate authority refused to reduce the rate or permit instalment payments. The court held the appellate order not amenable to writ interference and directed that requests for payment of interest in instalments be made to the Commissioner under the statutory relief mechanism. The note further states that a legislative amendment reduced the applicable interest rate retrospectively, so interest should reflect the lower rate.

      Audiovisual (AV) presentation of disclosures made in Public Issue Offer Documents
      Summary: Salient disclosures for main board public issues must be produced as bilingual Audiovisual (AV) presentations, approximately ten minutes per language, factual, non-promotional and compliant with Schedule IX publicity rules. AVs must equitably cover material sections of the DRHP/RHP (company, risk factors, capital structure, objects, business, promoters, management, financial summary, litigations, material developments, offer terms), include a caution directing reliance only on the Offer Document and Price Band Advertisement, be uploaded by issuers and AIBI within five working days of specified filings, made available across digital platforms and QR codes, updated upon RHP/prospectus and price band publication, and remain the responsibility of the Issuer and Lead Managers.

      Modification in Staggered Delivery Period in Commodity Futures Contracts
      Summary: SEBI amends paragraph 11.1.3 of the Master Circular for Commodity Derivatives Segment to provide that the minimum duration of staggered delivery period shall be at least three working days. The change applies to contracts with staggered delivery scheduled after July 01, 2024. Recognised stock exchanges and clearing corporations must notify members and publish the amendment on their websites. The circular is issued under Section 11(1) of the Securities and Exchange Board of India Act, 1992 and operates within the Delivery and Settlement provisions of the Master Circular, with other conditions unchanged.

      Launch of functionalities/features on Customs Brokers Licensing Management System (CBLMS).
      Summary: CBLMS has been enhanced to allow a two part Application for Continuation of License after Death of Proprietor under Reg.12 (Part I for eligibility verification and account access; Part II to submit remaining continuation details), a comprehensive Offence Module to manage offence reports, hearings, submissions, notifications and online penalty payment, and applications to modify CB profile data, addresses and add OPS and employee details; ancillary features include Issue Document, public Search CB, QR code status updates, in portal notifications, account lockout protection and user manuals.

      PUBLIC NOTICE No. 07/2024 - dated 1-3-2024
      Procedure for delivery of the Arrival/ Departure manifest-reg
      Summary: Temporary procedure permits electronic submission of IGM and EGM by email to designated addresses with PDF scans duly attested by the Authorized Signatory; emails must state Rotation Number, Vessel Name and ASA name in the subject. Cargo Declarations continue via ICEGATE and certain declarations remain submitted at Imports/Exports as mandated. Physical originals required for closure (e.g., bonds, draft survey reports) are to be presented at the Sevottam Counter against acknowledgement; Port Clearance will be issued electronically.
