      Summary: Introduces a fee of Rs.200 per day for late furnishing of TDS statements, capped at the total tax deductible for the delayed period, together with an additional penalty of Rs.10,000 to Rs.1,00,000 for not furnishing within the prescribed time. No penalty will apply if the statement is filed within one year after payment of tax deducted with interest and fee. A separate penalty of Rs.10,000 to Rs.1,00,000 is proposed for incorrect information in TDS statements. Corresponding amendments apply to TCS and take effect from 1st July, 2012.

      Summary: Sums credited as share capital, share premium or similar in the books of a closely held company are to be treated as explained only if the company explains the source of funds in the hands of the resident shareholder; this additional onus does not apply to registered Venture Capital Funds or Venture Capital Companies.       Clarification on Rate of Tax - regarding.
      Summary: Clarification states that the service tax rate applicable is the rate prevailing on the date the point of taxation occurs; for the eight specified services under Rule 7 and for services on which tax is payable under the reverse charge mechanism the point of taxation is the date of payment. Payments received or made on or after the effective date attract the restored rate. Invoices issued before the effective date may be supplemented to recover the differential, and Cenvat credit may be availed on supplementary invoices and tax payment challans subject to Cenvat Credit Rules, 2004.

      Foreign Direct Investment (FDI) in India - Issue of equity shares under the FDI scheme allowed under the Government route.
      Summary: Conversion of imported second-hand machinery is excluded from eligibility for issuance of equity or preference shares under the Government route for FDI, while all other terms of the earlier A.P. (DIR Series) Circulars remain unchanged. Authorised Dealer Category I banks must notify customers; amendments to the FEMA (Transfer or Issue of Security by a Person Resident Outside India) Regulations, 2000 will follow. Directions are issued under sections 10(4) and 11(1) of the Foreign Exchange Management Act, 1999 and are without prejudice to other statutory permissions.

      Foreign investment in Commodity Exchanges and NBFC Sector - Amendment to the Foreign Direct Investment (FDI) Scheme.
      Summary: Government prior approval is required only for the FDI component in commodity exchanges; registered FIIs may invest in commodity exchanges without Government approval, with other existing composite ceiling conditions remaining unchanged. For NBFC leasing and finance activity, FDI up to 100 per cent under the automatic route remains subject to minimum capitalisation, and FDI is permitted only for financial leasing, not operating leasing.

      Indo – China Border Trade.
      Summary: Five import items (readymade garments, shoes, quilts/blankets, carpets, local herbal medicine) and seven export items (processed food, flowers, fruits and spices, specified religious products, readymade garments, handicraft and handloom products, local herbal medicine) are added to the consolidated list of tradable goods under the Indo China Border Trade. All other provisions of earlier public notices remain unaltered and trade continues to be permitted only through the existing land customs stations specified in prior notifications.

      Summary: Customs must determine whether imported consignments infringe intellectual property rights by applying the relevant provisions of the parent IPR statutes and Notification No.51/2010-Customs(N.T.); parallel imports are to be decided using those statutory provisions and nodal ministry clarifications, noting that patents permit parallel imports, trademarks allow further dealing in lawfully acquired goods not materially altered, designs do not allow parallel imports, geographical indications contain no parallel import provision, and copyright guidance is pending.
