Summary: CBDT's Circular clarifies that the Rule prescribing a formulaic disallowance of expenditure related to exempt income applies even where an assessee has not earned exempt income during the year; the Circular relies on the statutory wording to justify invoking disallowance independent of actual exempt receipts, while critics argue this departs from legislative purpose and may conflict with judicial interpretations.
      By: Dr. Sanjiv Agarwal
Summary: Rule 15 penalises wrongful taking or utilisation of CENVAT Credit for inputs, capital goods and input services, exposing goods to confiscation and persons to penalties; aggravated misconduct involving fraud, wilful misstatement, collusion or suppression attracts additional penal provisions under central Excise and Finance Acts. Judicial guidance distinguishes bona fide or arguable interpretations and inadvertent mistakes from deliberate evasion, places the burden of proving admissibility on the claimant, links interest to utilisation of credit, and recognises a residual general penalty under Rule 15A where no specific penalty exists.

Summary: Supreme Court has stayed the operation and implementation of section 62(5) of the Punjab VAT Act, 2005, which required a prior minimum payment as a condition to entertain appeals; the interim order prevents application of that pre-deposit requirement to appeals under the Punjab VAT Act and the Central Sales Tax Act until further order.

Summary: SPMCIL reports year on year increases in production of bank notes, coins, security paper and security inks in the first ten months of fiscal 2014 15, sets higher annual production targets, notes reliance on existing (including ageing) machinery, and links output increases to self-sufficiency in security inks and corporatisation objectives to improve productivity and reduce counterfeit risk.
Summary: The central bank announces daily Reference Rates for the US dollar and the euro, compares them with the previous day's figures, and-using the USD reference rate and mid market cross currency quotes-provides derived rupee exchange rates for the British pound and the Japanese yen; the SDR to rupee rate is to be based on the published reference rate.
Summary: The Wholesale Price Index (base 2004 05=100) for January 2014 recorded a slight monthly decline with a moderation in the annual inflation rate. Primary Articles fell led by Food Articles (fruits and vegetables), Fuel & Power rose driven by higher LPG, aviation turbine fuel and petrol, and Manufactured Products showed a modest rise with mixed subgroup movements. Annexed tables provide weights, index levels, month over month, build up and year on year rates and a six month trend for key items; the next monthly release date is announced.
Summary: The Government divested a 10% equity stake in Engineers India Ltd through a Further Public Offering managed by appointed lead managers; the offer was oversubscribed, the issue price was fixed at the top of the price band, institutional demand composition at that price is reported, and the divestment reduced the government's holding while producing disinvestment proceeds based on the fixed price and offered shares.

      05/2014 - dated 11-2-2014
Clarification regarding disallowance of expenses under section 14A of the Income-tax Act in cases where corresponding exempt income has not been earned during the FY -regarding.
Summary: The Board clarifies that disallowance under section 14A read with Rule 8D applies even where an assessee has not earned exempt income in the year, because the statutory wording ''includible'' and ''income under the Act'' and Rule 8D's formulas tie disallowance to investments yielding exempt income rather than to receipts in the year.
      2.
      06/2014 - dated 11-2-2014
Clarification regarding scope of additional income-tax on distributed income under section 115R of the Income-tax Act -regarding.
Summary: The levy of additional income-tax under the provision applies only to income distributed to unit-holders as dividends by mutual funds or specified companies; receipts on redemption or repurchase of units and allotment of bonus units are not treated as distributed income for this purpose and therefore are outside the scope of the additional tax.
