<h1>India DIPP Opts Against New Guidelines for Patent Compulsory Licensing, Trusts Existing Legal Framework is Adequate.</h1> The Department of Industrial Policy and Promotion (DIPP) in India has decided not to issue additional guidelines for compulsory licensing of patents, as the existing legal framework under the Indian Patents Act and the TRIPS Agreement is deemed sufficient. This decision followed a review of 38 responses to a discussion paper, including input from international stakeholders and various associations. The Controller General of Patents has been instructed to handle compulsory license applications with care, not delegate this authority, and ensure timely decisions and compliance with reporting requirements. The Controller General will also review data from patentees annually.
