KCDA was found to be mandating a No Objection Certificate (NOC) from pharmaceutical companies before appointing new stockists, limiting drug supply in Karnataka. Lupin was complicit by refusing to supply drugs to a company without an NOC. The Commission imposed penalties on KCDA, Lupin, and their officials, directing them to cease this anti-competitive practice. KCDA faced a penalty of Rs. 8,60,321, while Lupin was fined Rs. 72.96 crores, with additional penalties on their officials.
