State wise VAT rate of Margarine

Dhvani Kamani

Hi, I am CA Dhvani Kamani, I want to know statewise VAT rate of Margarine. This name of product is not specified in any schedule. but in VAT schedule they are mentioned edible oil in $%. Whether margarine is under edible oil or it will fall under separate schedule. Please send me reply .

CA Dhvani Kamani

Classification as edible oil: margarine should be taxed under the VAT schedule and rate applicable to edible oils. Margarine, though not expressly listed in VAT schedules, has been held to fall within the category of edible oil; therefore, for VAT purposes margarine should be classified and taxed under the VAT schedule entry and rate applicable to edible oils rather than as a separate taxable class. The rate of VAT and Classification of Margarine may be decided with the help of Supreme Court Decision in Aluva Sugar Agency Versus State of Kerala[2011 (9) TMI 11 - SUPREME COURT OF INDI]

In this case, Margarine was held as edible oil.
