REGARDING OUR CLAIM FOR DEPB

My query is regarding claim for DEPB. Shipping bills are generated during Sept. 2006 to Jan-2007. Earlier the shipping bills generated during the above period was not reflected on the DGFT site, due to which are are unable to claim DEPB. Above all shipping bills are retransmitted / uploaded on the customs / DGFT site during May 2009. My query is, Can we claim DEPB of the above mentioned period's shipping bills ? Is our DEPB claim will be considered with in the time limit as perscribed under pare 9.3. of the FTP 2009-14. Please clarify.
DEPB claim timeframe depends on filing deadlines tied to EDI shipping bill uplinking; delayed claims may be considered under relief rules. DEPB credit applications must be filed within the post-export filing windows measured from export, from the uplinking of EDI shipping bill details on the DGFT website, or from printing/release of the shipping bill-whichever is later. If shipping bills were retransmitted and uplinked later, the uplinking date governs the start of the filing period, and a separate relief provision allows consideration of delayed claims arising from such retransmission or uplinking defects. You can claim DEPB for the above mentioned shipping bills and your claim will be considered with in the time limit as prescribed under para 9.3 of FTP

As per para 4.6 of Handbook of procedure, "Application for obtaining credit shall be filed within a period of twelve months from the date of exports or the date of up linking of EDI shipping bill details in the DGFT website, or within three months from the date of printing / release of shipping bill, whichever is later, in respect of shipments for which claim has been filed." Para 9.3 of handbook provide some relief and in case of delay. Therefore, I agree with Mr. Karthik Venkatasubramanian that you are eligible to file claim under para 9.3
