TDS - Date of Challan is Earlier then Date of Payment

TANGIRALA SUNDARA KUMAR

I have received one Form16A containing Date of Challan which is earlier then Date of Payment. Is it accepted by Department while filling of IT Return or not. Kindly guide me.

TDS timing rule: tax is chargeable on payment or credit, and deposited TDS with certificate supports credit in returns. TDS is chargeable at the earlier of payment or credit to the payee; this timing rule governs the tax point and deposit obligation. If the deductor has deposited the tax and issued a TDS certificate, the payee may claim credit in the return even if challan and payment dates appear mismatched; absent deposit or certificate, the payee should obtain evidence or rectification from the deductor to substantiate the claimed credit. TDS to be paid on payments or amounts credited to the deductees accounts whichever is earlier. In your case if amounts is credited to your account before payments and date of challan is later then Income Tax Dept. will accept it. Otherwise you may pray that payments TDS is made by the deductor to govt. and certificate is issued ,so you are rightly entitled to claim the TDS in your return ANAND SHEMBEKAR CELL NO 9209904370

Yes, in my view, you are eligible for credit of TDS deducted by the deductor.
