interest on late filing of gstr 3b paid twice, how to get it back

prabhu Chauhan

We have paid interest for late filing of GSTR-3BΒ  replying notice issued by department. It was before return for the next month was due. While filing the GSTR 3B for the next month, the system calculated the interest and paid.Β Β

how to get the excess interest paid refunded,

what could be the correct course of action in this situation in future.Β

regards

Refund of excess GST interest: claim under Rule 89 or adjust against future interest payments per CBIC guidance. Where interest on late-filed GSTR-3B has been paid twice-once responding to a departmental notice and again via the return filing system-the taxpayer may claim recovery of the excess by following the refund procedure under Rule 89 of the CGST Rules and the procedural guidance in CBIC Circular No.125/44/2019-GST. If the amount is significant, file a refund application; for minor amounts consider adjusting against future interest liabilities, retaining payment records and notices to substantiate the claim. Follow the procedure prescribed under Rule 89 of the CGST Rules and also CBIC Circular No.125/44/2019-GST dated 18/11/2019 to claim refund of excess payment of tax/interest.

File a refund application if the amount is significant.

Else adjust it against future interst payments, if any.
