gst registration

SHASHI MITTAL

Dear sir

one of the case is electricity bill is in the name of elder brother & the client has made self affidavit for gst registration ,consent letter can not be obtained due to fight between them so what to do,& how it should be shown , he has shop act license, kindly guide

GST registration: premises proof requirement may block registration absent rent deed or owner consent; alternative Shop & Establishment proof suggested. GST registration requires documented proof linking the applicant to business premises when utility bills are in another person's name; acceptable evidence includes a rent deed, proof of ownership, or a consent letter, as informal shared declarations are no longer accepted. An alternative suggested is relying on Shop and Establishment registration to support GST enrolment, though that approach may carry practical uncertainty. (AI Summary)

In the early days, the documentary proof regarding ownership of business premises was accepted on the basis of 'shared' by the Common Portal System and registration was issued. Due to frauds detected, Govt. has become very very strict and 'shared' is not accepted. Rent deed or proof of ownership or consent letter are requirement of GST law.

However, visit to Estate Office will also not be fruitful as all docs are in the name your client's brother. So chances are bleak. Only cordial relationship can click.

In our view, registration under Shop & Establishment Act will work for getting the registration under GST.
