Refund under Central Excise-reg

Date 03 Jul 2018

GST liability cannot be offset against Central Excise duty refunds; refunds and GST obligations remain separately payable.
Contributors agree that GST liability cannot be set off against a refund payable under the Central Excise Act because they arise under different laws; taxpayers should pursue the Central Excise refund and discharge GST dues separately, though revenue officials may in practice attempt administrative adjustments. (AI Summary)

Dear sir,

A taxpayers is to get refund of an amout under Central Excise Act, but the same taxpayer has some dues under GST. Now the issue is wheather the GST dues can be adjusted from the payable dues under Central Excise Act and what is the legal provision to deduct .

With regads,

M.Mukherjee
