Duty free import against invalidation letter

Dear All

We are a manufacturing unit registered under Central Excise and Customs, We manufacture Square Fibre Drum

We import our raw material - Kraft paper, with paying complete duty and do take the Cenvat benefit

Our product is mainly used for exports by our customer, they pack there product in our Drums and export

We wish to avail the benefit by saving the import duty

Every import container contains material for many different customers

Have been advised that if we take Invalidation letter from our Customers we can save on the import duty to that extent

Can some one please advice on the same as well as guide us the procedure to be adopted

Duty-free import via invalidation letter lets intermediate suppliers import inputs and supply or export under Advance Authorisation. Advance Authorisation or DFIA for intermediate supply may be issued only after invalidating the ultimate exporter's authorisation for direct import of the item; the invalidation letter is provided to the ultimate exporter, the intermediate supplier, and the Regional Authority. The intermediate supplier may supply to the ultimate exporter, supply directly to the port for export with the shipping bill in the name of the ultimate exporter and the intermediate supplier endorsed, or export directly. Regional Authorities consider applications based on tie-up arrangements. (AI Summary)

Sir,

According to para 4.30 of Foreign Trade Procedure 2015-2020 (From 1-4-2015 to 31-3-2020)

(a) Application for grant of Advance Authorisation or DFIA for Intermediate supply may be made on the basis of a tie-up arrangement with an ultimate exporter (physical / deemed) holding an Advance Authorisation or DFIA. Regional Authority concerned shall consider such requests.

(b) Advance Authorisation or DFIA for Intermediate supply shall be issued after making Authorisation of ultimate exporter invalid for direct import of item, to be supplied by intermediate manufacturer. In such case, a copy of the invalidation letter will be given to ultimate exporter holding Authorisation and copy thereof will be sent to intermediate supplier as well as Regional Authority of intermediate supplier. Intermediate Authorisation holder in such case has an option either to supply intermediate product to the holder of Advance Authorisation (i.e ultimate exporter) or DFIA or to export (physical / deemed) directly. Intermediate supplier can also supply the product(s) directly to the port for export by the ultimate exporter (holder of Advance Authorisation or DFIA). In such cases, shipping bill shall be in the name of the ultimate exporter with the name of intermediate supplier endorsed on it.

(c) Facility of Advance Authorisation shall be available even in cases where intermediate supplier has supplied or intend to supply material subsequent to fulfillment of EO by exporter holding Advance Authorisation / DFIA from where invalidation letter was issued.
