Service tax payment of individual on receipt basis if turn over less than 50 lakhs.

PRAVEEN KUMAR

I am a proprietor and my turnover in F Y 2015-16 is 70 lac, 42 lakhs from commission, 20 lakhs from renting immovable properties and 8 lakhs from providing hotel accommodation. I have separate service tax registration for each category and paying service tax on payment receipt basis.

My question is can I avail the 50 lakhs benefit of payment of service tax on receipt of payment basis in all type of services separately or consider in single turnover.

Please advise me……

Regards

Praveen

Eligibility to Pay Service Tax on Receipt Basis: Total Turnover Exceeds 50 Lakhs, Cannot Apply Separately Per Service An individual inquired about the eligibility to pay service tax on a receipt basis if their turnover is below 50 lakhs. The individual, a proprietor, reported a turnover of 70 lakhs in the fiscal year 2015-16 from various services, each with separate service tax registration. They asked if the 50 lakhs benefit could apply separately to each service. Responses indicated that the benefit cannot be applied separately and must consider the total turnover across all services.
