Merchant Exporter Claim for MEIS and Advance License

Export incentive entitlement: single shipment benefits cannot be claimed by two parties; disclaimer may allocate entitlement.
Entitlement to export benefits depends on shipping documentation and realization: the party named as ultimate exporter on the shipping bill who raises the commercial invoice and receives foreign exchange ordinarily claims the benefit, and only one party may claim benefits on a given set of shipping documents; a manufacturer's written disclaimer can permit another party to claim. Separately, distinct incentives may be claimed by different parties where each incentive rests on a separate legal basis (for example, advance authorisation for input-linked export benefits and MEIS incentives for exports). (AI Summary)

Dear Sir,

We X are merchant exporter of Pharmaceutical products, our supplier Y claims the exports benefits against Advance license as per our agreement and the shipping bill is filed under MEIS Scheme and Advance License scheme.

Can we X claim the MEIS benefits as a merchant exporter and our supplier Y is claiming the Advance license?

My main doubt is, whether a single shipment can be claimed two export benefits?

Thank you

Dear Friend,

You are right, any benefit/s on a particular set of document( Shipping Bill) can be claimed by one parson and not by two.

Since, the Shipping Documents/Shipping Bill contains the names of manufacturer and the Ultimate exporter ( who raises the commercial invoice and receive the foreign exchange can claim the benefit on a disclaimer from the manufacturer). Hence you may try for the disclaimer certificate as an alternative.

Yes, if your exporter is claiming advnce authorisation for export which is vaild, because he has exporting goods against procurement of imported inputs, this benifit is pertaining to qty and value wise. if he has received realization in indian rupees he will showing export thru third party.

MEIS which is incentive given by MOC for exporting goods. in such case you are eligalbe to take the advantage of MEIS incentive.
