service tax on construction

Pradeep Kumar

Sirs,

In our Pvt Ltd, company, some construction is going on - repair work as well as new one. Works are carrying out by a civil engineer. All materials will be supplied by him only and finally giving the bill for material cost and labor cost. Both the company and engineer are having service tax registration. Company do not have construction service in their service tax registration certificate.

Now the doubt is whether the company need to add the construction service in their RC, and if so, which category to be added - Construction service OR works contract?

Waiting for experts advice.

Company Advised to Register Under 'Works Contract Service' for Construction and Repair Work Involving Materials and Labor A private limited company is conducting construction and repair work through a civil engineer who supplies all materials and bills for material and labor costs. Both the company and the engineer have service tax registration, but the company lacks construction service in its registration certificate. The query seeks advice on whether to add construction service to their registration and under which category: construction service or works contract. Responses suggest registering under 'works contract service' due to the inclusion of materials and labor, with references to specific tax provisions and valuation differences between construction and repair works.
