EOU UNIT CAN TAKE BENIFIT OF NOT NO.12/2012 CUS dt 17.03.2012

SNEHAL SHAH

Dear sir,

We are manufacturing of pharma products and one unit is EOU unit . We are importing/procure raw materials and other materials with out payment of duty means getting full exemption under notification no. 52/03 as dated 31.08.2003 . We also apply application for EOU exit .

Can we take benefit of both Notification means 52/03 and 12/2012 for duty exemption because after getting NO DUE CERTIFICATE From Development commissioner we have to procure all materials with payment of duty , so for duty saving purpose we want to procure RM under not 12/2012 cus.

Kindly suggest sir ,

Regards,

SNEHAL SHAH

Pharma company can switch duty exemptions from Notification 52/03 to 12/2012 after exiting Export Oriented Unit scheme. A company involved in manufacturing pharmaceutical products, operating as an Export Oriented Unit (EOU), inquired about the possibility of utilizing duty exemptions under both Notification No. 52/03 and Notification No. 12/2012. The company is currently exempt from duty under Notification No. 52/03 but plans to exit the EOU scheme. Two responses clarified that while the company remains an EOU, it can benefit from Notification No. 52/03. However, upon exiting the EOU, they can avail themselves of the benefits under Notification No. 12/2012 for duty exemptions. (AI Summary)
