Manufacturing Firm Queries Service Tax on GTA Freight; Liability Clarified Under Reverse Charge, CENVAT Credit Applicable A manufacturing company inquires about the applicability of service tax on freight paid to a Goods Transport Agency (GTA) and whether they can claim input service tax credit. Experts clarify that either the consignor or consignee is liable to pay the service tax under the reverse charge mechanism, as per Notification No. 30/2012-ST. The company can claim CENVAT credit on service tax paid for inward materials. If the GTA charges service tax on their bill, it is incorrect, and the service receiver should only pay the freight amount, as the receiver is liable for the service tax under the law. (AI Summary)
