Destroying of old Records

Bhairob Chandra Bor

Dear Exparts,

we need to destroy some old records. It includes sales tax, excise, service tax, all vouchers, Journal vouchers etc. as per law (IT, EXCISE, SERVICE TAX, Company law) what should be the minimum period to kept all the records. If we destroy some records which are more than 10 years old , what should be the legal procedure/documentation for doing so? Kindly advice.

Kind Regards,

bcb

Guidance on Retention and Legal Destruction of Old Tax Records Under Indian Law A query was raised regarding the destruction of old records, including sales tax, excise, service tax, and various vouchers. The individual sought advice on the minimum period for retaining such records as per Indian laws and the legal procedure for destroying records over ten years old. The response indicated that records should be preserved if any adjudication, show cause notice, or court case is pending, even if they are over ten years old. Otherwise, records may be destroyed in accordance with specific legal provisions. (AI Summary)
