Dear Sir
I need your help in this regards. i run a proprietorship firm in Noida for technical consultancy, third party inspection to textile industries. Now I got an order for inspecting/checking the fabric at Pakistan from a shanghai company. So I contact a person in Pakistan to do the inspection at Pakistan. Now I want to send his service charge. He does not have any PE in india. As per my knowledge india do not have DTAA with Pakistan for this types of service. My questions are as below.
- Whether TDS is applicable on this payment or not.
- If it is applicable what is the rate.
- Since there is no DTAA with the Pakistan what will be the TDS rate in DTAA heading while filling the 15 CA form.
Business owner seeks guidance on TDS for service charges to Pakistan without DTAA; queries on 15CA form completion. A business owner in Noida, operating a proprietorship firm for technical consultancy and third-party inspection in the textile industry, seeks advice on remitting service charges to a contact in Pakistan for fabric inspection. The individual in Pakistan has no permanent establishment in India, and there is no Double Taxation Avoidance Agreement (DTAA) between India and Pakistan for such services. The business owner inquires about the applicability and rate of Tax Deducted at Source (TDS) on the payment and the appropriate TDS rate to declare under the DTAA heading when completing the 15CA form. A respondent asks if the issue has been clarified. (AI Summary)
