Deemed Export

narendra arora

Respected Sir,

I need your expert advice regarding following issue.

I have to make a supply of machines to a Govt. Project and according to FTP 8.2(j) the name of said project is mentioned in list 33, Sr.No. 511 of Notification No. 12/2012-Customs Dated 17.03.2012.

Please clarify:

 1. Is this supply/sale treated as Deemed Export ?

2. Is there any requirement of any document to establish Deemed Export ?

3. Is there any exemption/concession available on Customs Duty for procurement of imported inputs?

4. Can I avail CENVAT CREDIT on imported as well as indigenous procurement?

You are requested to spare some time for me and reply as earliest as possible.

Clarification sought on machine supply classification as 'Deemed Export' under FTP 8.2(j) and Notification 12/2012-Customs. A user inquired about the classification of a machine supply to a government project as a 'Deemed Export' under FTP 8.2(j) and Notification No. 12/2012-Customs. They sought clarification on whether this supply qualifies as a Deemed Export, the necessary documentation, available customs duty exemptions for imported inputs, and the eligibility for CENVAT credit on both imported and indigenous procurement. A respondent, MARIAPPAN GOVINDARAJAN, asked if the user had received clarification on the issue, indicating a follow-up on the initial query. (AI Summary)
