Import Clearance Eligibility Based on Shipment Date, Not Arrival; NAC Validity at Shipment Time is Key.
The circular from the Directorate General of Foreign Trade clarifies that the eligibility for clearance of import consignments is determined by the date of shipment or dispatch, as evidenced by the Bill of Lading, rather than the date of arrival in India. This applies even if the Nominated Agency Certificate (NAC) has expired by the time the goods arrive in India. As long as the NAC was valid at the time of shipment, the goods are eligible for clearance. This directive is issued with the approval of the Director General of Foreign Trade.
