Issues: Whether nickel cadmium rechargeable batteries imported for use in torch lights were importable under OGL by the respondent as an actual user under Public Notice No. 32/ITC/PN/92-97 dated 17-7-1992, and whether the goods were liable to be treated as consumer goods requiring a specific licence.
Analysis: The majority held that the batteries were not consumer goods capable of directly satisfying human needs without further processing, but were items intended for use in consumer durables such as torch lights. It was found that the goods were not specifically included in the negative list, that the respondent had been recognised as an actual user by the Industries Department and the adjudicating authority, and that the respondent satisfied the conditions of the public notice permitting import of accessories, components, parts and spares of consumer durables by a manufacturer subject to actual user conditions. Past clearances of similar goods were also treated as supporting the same view.
Conclusion: The respondent was entitled to import the goods under OGL in terms of the public notice, and the departmental appeal failed.
Ratio Decidendi: Where goods are not specifically in the negative list and are imported by an actual user for use in consumer durables, they may be imported under a valid public notice permitting such imports notwithstanding a general restriction on consumer goods.
