Issue (iii): Whether sums not includible in total income under Rule 4 of the Second Schedule excluded Chapter VI-A deductions.
Analysis: Rule 4 refers to income not includible in total income as computed under the Income-tax Act, and this expression does not take within it deductions allowed under Chapter VI-A.
Conclusion: The view in favour of excluding Chapter VI-A deductions was upheld; the assessee succeeded on this issue.
Final Conclusion: The revenue succeeded on the first two questions and the assessee succeeded on the third, so the appeals were disposed of with mixed results.
Ratio Decidendi: Amounts set apart to meet an ascertained liability or identified doubtful debts are provisions, not reserves, for surtax capital computation, while Rule 4 of the Second Schedule does not refer to Chapter VI-A deductions.
