Issue (i): Whether the classification of the Bulk Mix Delivery System under Heading 87.05 of the Central Excise Tariff was to be upheld.
Analysis: The appellants did not contest the classification adopted by the Department. In the absence of any challenge, the classification determined by the lower authorities was accepted.
Conclusion: The classification under Heading 87.05 was upheld, against the assessee.
Issue (ii): Whether penalty was imposable in a dispute relating to classification of the product.

Issue (iii): Whether the matter required remand for examination of eligibility to the benefit of Notification No. 5/98-C.E. dated 2-6-98.
Analysis: The eligibility of the impugned product for exemption under the notification had not been examined by the lower authorities. The question needed factual and legal examination at the first instance after hearing the assessee.
Conclusion: The matter was remanded to the jurisdictional adjudicating authority for fresh examination of notification benefit, in favour of the assessee.
Final Conclusion: The classification was sustained, the penalty was deleted, and the exemption issue was sent back for reconsideration by the adjudicating authority.
Ratio Decidendi: Where a classification dispute is not pressed, the classification may be upheld, but penalty may still be unsustainable and exemption eligibility may require remand when it has not been examined by the lower authorities.
