Issue (i): Whether use of the marks "DVK" and "Popular", along with the appellant's own name, disentitled the goods from Small Scale Industry exemption.
Analysis: The markings "DVK" and "Popular" were found to be used on the goods together with the appellant company's name. The record did not show that those abbreviations or words were being used by another person as a brand name in the relevant trade, nor that they were used to indicate a connection in the course of trade. The markings appeared to identify goods meant for particular customers. The settled principle applied was that exemption is not denied unless the goods bear the brand name of another person.
Conclusion: The use of "DVK" and "Popular" did not disentitle the appellants from Small Scale Industry exemption.
Issue (ii): Whether duty and penalties could be sustained in respect of the mark "Hansu".
Analysis: The mark "Hansu" was admittedly the brand or trade name of Hansu Controls Ltd. and the materials on record supported that finding. Accordingly, denial of Small Scale Industry benefit was justified only for goods bearing that mark. The duty demand was therefore restricted to that part of the clearances. Since the question of eligibility on use of another person's mark involved mixed issues of law and fact and had been settled by the apex court, no penalty was found sustainable.
Conclusion: Duty was confirmed only to the extent of Rs. 1,15,409 for goods bearing "Hansu", and the penalties were set aside.
Final Conclusion: The appellants succeeded on the exemption issue relating to "DVK" and "Popular", while the demand was sustained only for the goods bearing "Hansu", with penalties deleted.
Ratio Decidendi: Small Scale Industry exemption is not denied merely because goods bear markings that do not constitute another person's brand name in the course of trade, but it can be denied where the mark is admittedly the brand or trade name of another person.
