Issues: Whether the applicant was entitled to bail under Section 439 of the Code of Criminal Procedure, 1973 in view of the material collected during investigation, the applicant's antecedents, and the invocation of the Maharashtra Control of Organised Crime Act, 1999.
Analysis: The application was considered against the background of CDR location records, phone calls to co-accused, the alleged role of the applicant as gang leader, the fact that this was a second case in which the MCOC Act was invoked against her, and her prior externment from Pune city. On that material, the Court found that the applicant could not establish a basis for bail merely by asserting absence from the spot or absence of direct demand allegations.
