1. ISSUES PRESENTED AND CONSIDERED
(i) Whether the applicant's temporary bail already granted on medical grounds should be extended in light of the medical report describing his post-surgical condition and ongoing chemotherapy-related complications.
(ii) Whether an independent medical evaluation by a public hospital panel should be directed to assess the applicant's present health status for deciding the further question of bail on medical grounds.
2. ISSUE-WISE DETAILED ANALYSIS
Issue (i): Extension of temporary bail on medical grounds
Legal framework: The Court proceeded on the premise of its discretionary power to grant and extend temporary bail on medical grounds, as already exercised by its earlier order granting temporary bail subject to execution of a personal bond with sureties.
Interpretation and reasoning: The Court considered the medical case summary stating that the applicant was diagnosed with adenocarcinoma of the colon, underwent surgery with colostomy, remained "very weak and fragile" requiring continuous nursing and specialized stoma care, had urinary complications and infection requiring antibiotics and possible further prostate treatment, and was on chemotherapy with significant side effects and progressive worsening requiring repeated hospital visits and supportive care. The report further indicated prolonged recovery and foreseeable dependence on continued specialized care and monitoring.
Conclusions: In view of the medical report, the Court extended the temporary bail by a further period of two weeks from the date of the order, maintaining the earlier bail arrangement already granted.
Issue (ii): Direction for independent medical examination by a panel and further consideration of medical bail
Legal framework: The Court applied its supervisory and fact-finding discretion to seek an independent medical assessment to assist in deciding whether bail on medical grounds should be granted beyond the temporary period.
Interpretation and reasoning: Given the nature of the asserted medical condition and ongoing treatment, the Court deemed it appropriate to obtain an examination and report from a panel comprising specified specialists under the Dean of a public hospital, with directions to consider the applicant's prior medical case papers from the private hospital where treatment was undertaken.
Conclusions: The Court directed the applicant's examination by the constituted panel on a specified date, ordered submission of a health-condition report to the Court after considering earlier treatment records, and listed the matter for consideration of whether the applicant should be granted bail on medical grounds.
