Pant Institute of Post Graduate Medical Education and Research. It is felt appropriate that the citizen is having a right to take treatment of his choice, at his own expenses, in a private hospital. It is deemed appropriate to release the petitioner on interim bail on medical grounds for a limited period of six weeks. Until the next date of listing, the petitioner be released on interim bail on medical grounds, on such terms and conditions as may be imposed by the trial court, with additional conditions imposed - Re-list the matter for further orders on 10.07.2023. Interim bail was sought on medical grounds, citing weight loss and the petitioner's medical condition, relying on a medical report dated 04.05.2023 from a government medical institute. The Enforcement Directorate opposed interim bail and requested an independent medical examination at AIIMS. The Court held that, 'at present there is no reason to disbelieve' the cited medical report and emphasized that 'the citizen is having a right to take treatment of his choice, at his own expenses, in a private hospital.' On that basis, the Court ordered release on interim bail on medical grounds 'for a limited period of six weeks,' subject to trial court terms and additional conditions: the petitioner shall not 'influence and meet with any of the witnesses' in the witness list; shall not leave the National Capital Region without trial court permission; shall produce 'relevant treatment papers and prognosis' during interim bail; and shall refrain from appearing in print/electronic media or on social media to make statements on any issue during interim bail. The matter was directed to be re-listed on 10.07.2023.
