Bail denied for alleged assistant teacher recruitment scam accused of taking money promising appointments; investigation ongoing
HC refused bail to the petitioner, finding materials (including statements by aspirants) indicating the petitioner received money promising appointments ... Seeking grant of bail - It is submitted on behalf of the petitioner that he has been falsely implicated in the instant case - HELD THAT:- Present case was registered in connection with a scam regarding appointment of Assistant Teachers for Class IX and X through SSC in Government and Government aided schools. Statements of the aspiring candidates show they had paid money to the petitioner on the assurance they would be given appointment. These materials disclose involvement of the petitioner in the alleged crime. In view of the nature of crime involving brazen acts of corruption in mattes of public employment and active role played by the petitioner therein and as further investigation is in progress, it is not inclined to grant bail to the petitioner at this stage. The prayer for bail of the petitioner is rejected. Petitioner, in custody for 370 days, sought bail alleging false implication and absence of his name in the FIR and initial charge sheet. CBI opposed bail, charging petitioner as the 'principal agent' in a scam concerning appointments of Assistant Teachers (Class IX-X) through the School Service Commission, alleging inducement of aspirants to pay illegal gratification and accumulation of wealth 'disproportionate to his own source of income.' Record and CBI report, including statements of aspiring candidates, indicate payments made to the petitioner on assurance of appointment and disclose his involvement. Given the matter involves 'brazen acts of corruption in matters of public employment,' the court noted the petitioner's active role and that 'further investigation is in progress.' The court held that, on these materials and the ongoing investigation, 'we are not inclined to grant bail to the petitioner at this stage,' and accordingly the prayer for bail 'is rejected.'
