Hence, the Appeals are allowed. The Supreme Court of India, in Criminal Appeal Nos. pending before Hon'ble Justices Abhay S. Oka and Augustine George Masih, granted leave and allowed bail to appellants charged with Magistrate-triable offences. Despite the Government of Uttar Pradesh's apprehension regarding potential witness tampering due to the large scam amount involved, the Court emphasized the absence of antecedents against the appellants and the nature of the offences as triable by a Magistrate. The Court held that 'there is no reason to deny bail,' directing that appellants be produced before the Trial Court within one week, which shall grant bail on 'appropriate terms and conditions' after hearing the Public Prosecutor, including the possibility of imposing 'stringent terms and conditions.'
