Article 15(1) of the DTAA states that salaries, wages, and other similar remuneration derived by a resident of a contracting state (UAE) in respect of employment shall be taxable only in that state unless the employment is exercised in the other contracting state (India).

The Tribunal referred to the UN Model Convention Commentary and OECD publications, which suggest that ESOP benefits relate back to the period when the options were granted.
