                            Revenue's Appeal Partially Allowed for A.Y. 2011-12; Assessee's Cross Objections Dismissed

                            The Tribunal partly allowed the revenue's appeal for A.Y. 2011-12 for statistical purposes, but dismissed the appeals for A.Ys. 2012-13 to 2014-15. The cross objections filed by the assessee for those assessment years were also dismissed.

However, the Tribunal remitted the matter back to the AO to verify whether the assessee had claimed double deductions in the earlier years.

                            The AO disallowed the expenditure claimed by the assessee for the waiver of penal interest and other interests under schemes announced by APCOB and KDCCB. The AO observed that the assessee did not follow RBI guidelines to take such losses to the General Reserves below the line and had enough provisions for bad debts and reserves to cover these waivers. The AO added back the amounts to the income for the respective assessment years.

                            The CIT(A) deleted the addition, following his own order of the earlier years and the decision of the ITAT in the case of Nizamabad District Cooperative Central Bank Ltd.
