Issues: Whether the applicant was entitled to bail in a second application under Section 439 of the Code of Criminal Procedure, 1973 on the basis of any change in circumstances after rejection of the first bail application.
Analysis: The earlier bail application had already been rejected on merits. The Court found that the charge-sheet and arrest of co-accused did not, by themselves, constitute a material change in circumstance. It also noted prima facie irregularities and illegalities in the execution of the sale deed, the alleged criminal conspiracy involving unauthorized persons, and the incomplete payment of the sale consideration. In these circumstances, the Court held that no fresh ground was made out for grant of bail.
