Issues: Whether the conviction of the accused for culpable homicide not amounting to murder could be sustained on the basis of the eye-witness account, medical evidence, forensic evidence, and the alleged delay in lodging and forwarding the FIR.
Analysis: The FIR was found to have been lodged promptly and the alleged ante-dating or manipulation was rejected. The delay in forwarding the FIR to the Magistrate was held not to be fatal in the absence of any demonstrated prejudice, especially when the officer who could have explained the delay was not questioned. The forensic report was inconclusive on definitive linkage of the bullet to the recovered pistol, but there was no mismatch between the weapon and the projectile, and the ocular version that the accused fired the shot was not displaced. The absence of blackening was not treated as destructive of the prosecution case because the evidence showed a close-range shot and the clothing could reasonably explain the medical finding. The absence of a blood trail and the fact that the deceased moved some distance after being shot were held not to discredit the prosecution, and the eye-witnesses were found consistent and reliable.
Conclusion: The prosecution case was proved beyond reasonable doubt, the conviction was maintained, and both appeals were dismissed.
Ratio Decidendi: Where prompt lodging of the FIR, reliable eye-witness testimony, and a medically and forensically compatible prosecution version exist, an inconclusive forensic linkage or delay in forwarding the FIR to the Magistrate, without demonstrated prejudice, does not by itself vitiate the conviction.
