Issue (i): Whether exoneration of the detenu in adjudication proceedings under foreign exchange law invalidated the preventive detention order.
Analysis: Preventive detention and adjudication or penal proceedings operate in different fields, serve different purposes, and are founded on different considerations. Exoneration in adjudication does not, by itself, nullify the basis of preventive detention. The later adjudication order in favour of the detenu did not establish that the detention order was mala fide or without application of mind. The power of detention remains available even where the adjudication proceedings end in favour of the detenu.
Conclusion: The contention was rejected and the detention order was not invalidated on this ground.
Issue (ii): Whether delay in execution of the detention order snapped the live-link where the detenu had absconded and a proclamation was issued under the Act.
Analysis: A long delay in executing a detention order may, in an appropriate case, affect the live-link between the grounds of detention and the need for detention. However, where the delay is attributable to the detenu's own absconding conduct and the authorities had issued a proclamation under section 7(1)(b) of the Act, the delay is explained and the live-link is not snapped. On the contrary, evasive conduct of the detenu strengthens the inference that preventive detention continued to be justified.
Conclusion: The challenge based on delay failed and the detention order remained valid.
Final Conclusion: The petition was dismissed because neither the adjudication exoneration nor the delay in execution displaced the preventive detention order.
Ratio Decidendi: Exoneration in adjudication proceedings does not bar preventive detention, and delay in execution caused by the detenu's absconding does not snap the live-link justifying detention.
