Issues: Whether Section 8 of the Hindu Minority and Guardianship Act, 1956 applies to a sale of joint Hindu family property by the Karta so as to require previous permission of the court for the minor's undivided interest.
Analysis: Sections 6, 8 and 12 of the Act were read together as a single scheme. Section 6 excludes the minor's undivided interest in joint family property from the ordinary rule of natural guardianship. Section 8 governs the powers of a natural guardian in respect of a minor's property, but that provision was held not to extend to undivided interests in joint family property.
