Analysis: The distinction between public order and law and order turns on the degree and reach of the disturbance and its impact on the even tempo of community life. An act directed against a particular individual does not, by itself, justify preventive detention unless its impact is so that it creates terror, panic, or a general disturbance of public tranquillity in the locality. On the facts, the alleged incident arose out of business rivalry, was confined to the complainant, caused no injury or damage, and was not shown to have affected the community at large.
Conclusion: The detention could not be justified as a measure for maintenance of public order and was therefore unsustainable; the issue was decided in favour of the appellants.
Ratio Decidendi: Preventive detention on the ground of public order is valid only when the act's reach, effect, and potentiality disturb community life beyond an individual dispute and affect the even tempo of the locality.
