Issues: (i) Whether the expenses incurred for Griha Pravesam and Ritusanti formed part of the legitimate marriage expenses recoverable from the person liable in law; (ii) Whether the plaintiff was entitled to sue for reimbursement of the sums paid under Section 69 of the Indian Contract Act.
Issue (i): Whether the expenses incurred for Griha Pravesam and Ritusanti formed part of the legitimate marriage expenses recoverable from the person liable in law.
Analysis: The ceremonies of Griha Pravesam and Ritusanti were treated as essentially connected with the marriage disposal of a Brahmin girl and as ordinarily forming part of the marriage ceremonies. The fact that such ceremonies were not performed consecutively as in earlier times did not alter their character or the liability of the person bound to meet the marriage expenses.
Conclusion: The claim for Rs. 155 towards Griha Pravesam and Ritusanti was allowed in favour of the appellant.
Issue (ii): Whether the plaintiff was entitled to sue for reimbursement of the sums paid under Section 69 of the Indian Contract Act.
Analysis: The plaintiff had an interest in making payment of expenses which the defendant was legally bound to bear. On that footing, the suit was maintainable under Section 69 of the Indian Contract Act.
Conclusion: The plaintiff was entitled to sue and recover the amount paid for those legitimate expenses.
Final Conclusion: The decree was modified so as to permit recovery only of the proved legitimate marriage expenses, while the remaining claims were disallowed.
Ratio Decidendi: Expenses that are essentially part of the recognized marriage ceremonies are recoverable from the person legally liable to bear them, and a person interested in discharging that liability may sue for reimbursement under Section 69 of the Indian Contract Act.
