Issues: Whether the criminal proceedings arising out of the complaint alleging cheating, forgery and use of forged documents should be quashed under the inherent jurisdiction of the Court.
Analysis: The complaint alleged that the accused had represented that the machinery offered for hire purchase was free from encumbrance, issued a no lien certificate, and thereby induced the complainant to part with money, while the machinery was already subject to a prior charge. The existence of fraudulent or dishonest intention from the inception is a necessary ingredient of cheating, and whether such intention existed, as well as whether the complainant had notice of the earlier charge, are matters for trial. The contention that the dispute is purely civil in nature did not persuade the Court, as the complaint disclosed allegations of criminal deception and fabrication that could not be rejected at the threshold.
Conclusion: The Court refused to quash the proceedings and held that interference at the stage of the petition was not warranted.
