On hearing submissions from both parties and noting that the appointment to the post has since been made, the Commission found that the basis for withholding the information no longer warranted non-disclosure. In view of the completion of the appointment process, the public interest in disclosure prevailed and the exemption relied upon could not be sustained to deny the requested information. The CPIO was directed to furnish the information to the appellant within ten working days from receipt of the order.Information regarding the movement of the proposal/file for the appointment is to be disclosed; CPIO directed to provide the information within ten working days.Final Conclusion: The appeal is allowed; the CPIO is directed to supply the requested information about the appointment process of the President of the CESTAT within ten working days, and the appeal is disposed of. The Central Information Commission directed the CPIO to provide information to the appellant regarding the appointment of the President of the CESTAT within 10 working days. The appeal was disposed of accordingly.
