Issues: Whether a person who is shown only to have arranged or attempted to acquire smuggled gold after it had reached India can be said to be "concerned in" its importation so as to attract penalty under item 8 of section 167 of the Sea Customs Act.
Analysis: Item 8 of section 167 penalises a person concerned in the offence of importation of prohibited goods. The expression "concerned in" is wide, but it still requires proof that the person took part in some act or series of acts which formed part of the process of importation. Importation is complete when the goods cross the customs barrier and reach the borders of the country. Mere possession, receipt, negotiation, or dealing with smuggled goods after importation is different from participation in the importation itself. On the facts, there was no evidence connecting the respondent with any pre-import act or with the bringing of the gold into India; at the most, the materials suggested suspicious dealing in smuggled gold.
Conclusion: The respondent was not shown to be concerned in the importation of the gold, and no personal penalty under section 167(8) could be sustained.
Ratio Decidendi: Liability under section 167(8) of the Sea Customs Act arises only when there is evidence that the person participated in the process of importation itself; dealing with smuggled goods after importation is not enough.
