Final Conclusion: The assessee succeeded on the maintainability objection and on the substantive tariff classification issue, and the impugned order was set aside with consequential relief.
Ratio Decidendi: A conclusive direction affecting duty liability is an appealable order, and tariff classification must be determined by the essential use of the goods rather than by their physical form unless the tariff entry expressly requires a particular form.
Dissenting Opinion: One Member held that the Appellate Collector had not passed an appealable order regarding the disputed consignment because he merely referred the parties to the Collector's earlier decision, and that the proper challenge lay only against the Collector's order in revision. On that view, the appeal was rejected.
