Issues: Whether process cameras, dark room camera, gallery camera, vertical camera, semi-automatic vertical camera, photographic image processors and parts of camera are classifiable under Heading 90.08 as photographic enlargers and reducers, or under Heading 90.06 as photographic cameras.
Analysis: The classification turned on the functional utility of the goods. The items were found to be process cameras used mainly in the printing industry for enlarging or reducing images and for reproduction of two-dimensional objects only. The reasoning adopted below distinguished process cameras from photographic cameras, noting that process cameras differ in focus, output, colour reproduction and intended use. The HSN notes under Heading 90.06 exclude photographic enlarging or reducing apparatus and place them under Heading 90.08. In the absence of contrary evidence from the Revenue, the finding that the goods were not ordinary photographic cameras was upheld.
Conclusion: The goods were correctly classifiable under Heading 90.08 and not under Heading 90.06, and the Revenue's challenge failed.
