Issue (i): Whether the adjudication order was liable to be set aside for want of a reasonable opportunity of hearing and breach of natural justice
Analysis: The show cause notice had not been effectively served and no reply had been filed by the appellants, yet the record showed their intention to contest the matter. In those circumstances, fairness required that one effective opportunity be given to present the defence before adverse findings were affirmed.
Conclusion: The order could not be sustained without affording a reasonable opportunity of hearing, and the matter had to be remanded.
Issue (ii): Whether the dispute regarding description, valuation and classification of the imported goods required re-adjudication in the light of the larger bench decision
Analysis: The controversy on whether the consignments were correctly described as sets or were complete TV kits, together with the consequential valuation and classification questions, had to be reconsidered. The larger bench ruling in the subsequently rendered decision governed the approach to these issues, and the adjudication had to be revisited accordingly.
Conclusion: The valuation and classification dispute was directed to be readjudicated afresh in accordance with law and the larger bench ruling.
Final Conclusion: The impugned order was set aside and the matter was sent back for fresh decision after hearing both sides, resulting in success for the appellants by way of remand.
