Constitution 82nd Amendment Restores Relaxations in Promotion Reservations for Scheduled Castes and Tribes Under Articles 16(4) and 335.
The Constitution (82nd Amendment) Act, 2000 was enacted to address the Supreme Court's ruling that disallowed relaxations in qualifying marks and evaluation standards for Scheduled Castes and Scheduled Tribes in reservation promotions, as per Article 16(4) and Article 335. The Supreme Court's decision, based on the Indira Sawhney case, led to the withdrawal of these relaxations in 1997. Due to adverse effects on these communities and subsequent representations, the government decided to amend the Constitution to restore the withdrawn relaxations, thereby addressing concerns raised by various stakeholders, including Members of Parliament.
