Preferential rate of duty claims face compulsory verification, disallowance for suppression, and override by the Rules of Origin.

Failure to furnish requisite information and documents, or failure to exercise reasonable care, requires compulsory verification of subsequent preferential bills of entry under section 17(2) to prevent misuse of a trade agreement, and the measure ends when reasonable care is shown through adequate record-based controls. Suppression of facts, wilful misstatement, or collusion to obtain undue benefit leads to disallowance of the preferential claim and penal action. In case of conflict, the Rules of Origin prevails, and the Central Government may relax specified provisions by notification.
