Company investigations continue despite voluntary winding up or pending winding-up proceedings; tribunal may direct and directors remain liable.

An investigation may be initiated and shall not be stopped or suspended solely because of an application under section 241, a special resolution for voluntary winding up, or any other pending winding-up proceeding; where the Tribunal makes a winding-up order the inspector must inform the Tribunal and the Tribunal may make such orders, and a winding-up order does not absolve any director or employee from participating in the inspector's proceedings or from liability arising from the inspector's findings.
