Case Laws Income Tax
Unexplained property-payment sources require evidence that prior bank withdrawals were otherwise used before rejecting the taxpayer's explanation.
Unexplained-source addition for property payments cannot be sustained merely because earlier recorded bank withdrawals preceded the payments by a time gap. Where withdrawals are not shown to have been used for another purpose and the taxpayer also relies on business income and LIC maturity proceeds, the explanation requires consideration on the facts. Only a limited unexplained component remained assessable, while the balance addition was deleted.

Bona fide uncertainty over leave fare concession taxability defeated penalty for short deduction of tax at source.
Penalty for short deduction of tax at source on leave fare concession reimbursements involving overseas travel was unsustainable where the employer acted on a bona fide, previously debatable understanding that exemption applied if the designated destination was in India. That understanding was supported by an interim High Court order, although the Supreme Court later clarified that tax was deductible on such reimbursements. The short deduction was inadvertent and lacked intent to evade tax; accordingly, the penalty was deleted for both assessment years.

Case Laws Income Tax
Reassessment on investigation information fails without fresh tangible material, while unsupported estimated purchase additions cannot stand on audited records.
Reassessment after a completed scrutiny assessment cannot rely solely on investigation-wing information or a third-party opinion where the purchases, books and relevant bank account were already examined. Fresh tangible material, independent enquiry and a valid belief that income escaped assessment are required; after four years, reopening also requires failure to make full and true disclosure of material facts. An estimated purchase disallowance as unexplained expenditure requires supporting evidence. Where purchases and corresponding sales are recorded in audited books, sales remain undisputed and the expenditure source is not questioned, an ad hoc addition lacks evidentiary basis.

Case Laws Income Tax
Fair market value substitution without valuation evidence cannot support a capital-gains addition or reduce proven improvement costs.
Substitution of an assessee's declared fair market value as on 01.04.1981 for capital-gains computation requires supporting material. Rejecting that value through a backward calculation based on sale-deed value, without a reference to the Departmental Valuation Officer or evidence showing the declared value was incorrect, was unsustainable. Reduction of the claimed cost of improvement also required contrary evidence; absent such material, the declared cost had to be accepted. The capital-gains addition arising from the substituted value and reduced improvement cost was directed to be deleted.

Faceless assessment challenge permits reassessment to continue while suspending effect of any adverse order pending further hearing.
Reassessment proceedings initiated by the jurisdictional Assessing Officer were challenged as inconsistent with the Faceless Assessment Scheme. The issue was identified as identical to questions pending in a batch of writ petitions, and no final determination was made. Reassessment may continue; however, any adverse order must not be given effect until the next listing.

Prior adjudication bars advance ruling where revised contracts retain the same coal sale and cargo-handling question.
Advance-ruling applications are barred under the first proviso to Section 98(2) where the question raised has already been decided in proceedings involving the applicant. Altered contractual clauses do not establish a new question when the substantive business model remains the sale of coal with separate invoicing for alleged cargo-handling services. Prior proceedings determined that no cargo-handling service was supplied and that invoices were issued to pass input tax credit. The application was therefore inadmissible because its central question had already been decided.

Temporary suspension of high tariffs on Colombian products has been sought to support business recovery following a severe earthquake declared a natural disaster. The request links tariff relief to economic disruption affecting businesses amid extensive destruction, injuries and missing persons. United States emergency assistance has been provided through food, shelter and health supplies, while no response to the tariff-suspension request had been reported.

Mission Samudra is proposed as a port-led industrial and logistics development programme linked to the commencement of export-import operations at Vizhinjam seaport. It covers industrial clusters, new cities, port connectivity, logistics, development initiatives, programme management and capacity building. Direct export shipments are intended to improve overseas-market access and reduce transit time and logistics costs, particularly for small and medium enterprises. The framework also anticipates growth in warehousing, cold storage, container freight stations and logistics parks, supported by private participation and road and rail connectivity.

India's electric motor car exports expanded sharply in the first quarter of 2026-27, reflecting increased international acceptance and competitiveness of India-manufactured electric vehicles. Europe became the principal export destination, led by Spain and the United Kingdom, with further demand across several European markets. Exports also reached Asia-Pacific markets, Nepal and emerging Latin American destinations. This wider market presence reflects improving quality and safety standards, stronger integration into global electric-vehicle supply chains, and diversification of India's electric-vehicle export profile.

Interest is payable from the date of payment to the date of refund where an amount paid as appellate pre-deposit becomes refundable following an appellate order. Form GST RFD-01 may be filed electronically with the relevant orders, payment details and a computation that separately identifies the refund, appellate pre-deposit and interest claimed. Interest on other appellate-order refunds may apply where the refund is delayed beyond the prescribed period after receipt of the refund application. Refund-processing jurisdiction should be verified before pursuing the claim.

Government has established a standing LPG production preparedness framework under which refining companies, oil marketing companies and upstream producers may be directed to increase production during supply constraints. Companies must maintain adequate LPG storage, evacuation and transportation infrastructure and pursue technically and economically feasible production-enhancing measures. Written directions may prescribe production quantities and periods, including restrictions on alternative uses of input streams required for LPG. The production schedule is updated twice yearly to reflect new facilities and added capacity from infrastructure, technology and distribution improvements.

Free trade agreements expand market-access opportunities for Indian MSMEs, exporters and producers through reduced or eliminated import duties on traded goods. Textiles, machinery, medicines, seafood and agricultural products can access international markets where they meet global standards and remain competitively priced. Farmers and producers are encouraged to develop export-oriented products, including chemical-free agricultural produce, while MSMEs may use preferential trade access to support manufacturing, exports, employment and growth.

Depreciation on an asset received in kind through a corpus or specific-purpose donation should ordinarily be charged to the Income & Expenditure Account, with accumulated depreciation reducing the asset's carrying value. The corpus or specific-purpose fund should remain separately presented according to donor terms and accounting policy. Direct adjustment of depreciation against that fund is appropriate only where donor restrictions, governing terms and the applicable accounting framework specifically permit it. Tax restrictions on depreciation as application of income remain distinct from book accounting treatment.

GST registration depends on whether personal bank fixed-deposit interest is outside the scope of supply or is an exempt supply includible in aggregate turnover. If the deposits are personal investments and commercial renting is the only GST supply, with tax wholly payable by the registered tenant under reverse charge, the exemption for exclusive reverse-charge supplies supports non-registration. The contrary view includes deposit interest in aggregate turnover, requires registration on crossing the threshold, and treats commercial rent as taxable under forward charge after registration.

Indian pharmaceutical companies are urged to attain representation among the world's five leading pharmaceutical firms, despite India's established position as a major producer of generic medicines. India has a broad manufacturing base, supplies generic medicines across numerous therapeutic categories, and exports to worldwide markets including highly regulated jurisdictions. Although pharmaceutical exports and the domestic market have expanded, Indian firms have not yet secured positions among the largest global companies. Greater international scale may be supported through acquisitions and expanded established-brand and branded-generic operations.

Free trade agreements are presented as export-market opportunities for Indian MSMEs because they reduce or eliminate import duties on a substantial range of traded goods. MSMEs are urged to expand exports of textiles, machinery, medicines and seafood, including shrimp, by meeting global quality standards and offering products competitively. Their export role is linked to self-reliance and their significant contribution to manufacturing, exports, GDP and employment.

Special additional excise duty (windfall gains tax) on exports of petrol, diesel and aviation turbine fuel was reduced from 15 August 2026. Petrol export duty was reduced to nil, and export-duty rates on diesel and ATF were lowered. Duty rates for petrol and diesel cleared for domestic consumption remained unchanged. The export-duty framework seeks to maintain domestic petroleum-product availability and limit export advantages arising from higher global crude oil prices amid West Asia tensions.
